Responding to COVID-19: JobKeeper Stage 2 Templates

October 2020 brought with it some changes to JobKeeper Criteria. The government has passed bills through parliament to extend the JobKeeper scheme. The extended scheme is made up of two extension periods: 28th of Sep 2020 to 3rd of January, 2021 and January 4, 2021 to March 28, 2021. For each period businesses intending to claim JobKeeper will need to meet the decline in turnover test and the rate of the payment will reduce based on tiers and hours of work.

Two categories of employers have been created, Qualifying Employers and Legacy Employers.

Qualifying Employers are employers who are eligible for JobKeeper Payments after September 28, 2020. The employers will need to meet the new turnover test to access all JobKeeper powers (except for the provisions regarding annual leave). Qualifying Employers may issue directions and come to agreements with employees who are entitled to receive JobKeeper Payments.

Legacy Employers are employers who received one or more JobKeeper Payments before September 28, 2020 and no longer qualify after that date, but are still experiencing a 10% decline in turnover. Legacy Employers will have access to modified powers after September 28, 2020. These employers can issue directions and come to agreements with employees who were previously receiving JobKeeper payments.

The templates will guide employers through the notification and consultation steps needed to exercise the updated powers. Employers should determine whether they are regarded as Qualifying Employers or Legacy Employers and use the appropriately named ‘Notice of Intention’ templates.
