On 12 November 2016, new legislation came into effect for unfair contract terms, extending existing legislation to small businesses.

So, what does this mean?

A contract term is considered unfair if it has an imbalance of rights and power, is unnecessary for the protection of the party that benefits from the term, or disadvantages a small business, financially or otherwise.

If a Court deems a contract term unfair, the term becomes voided, with the rest of the contract still upheld.
