Frequently Asked Questions

If you are considering engaging You Legal to prepare an Employment Agreement for General Practitioners (“GPs”), here’s what you need to know:

What is an Employment Agreement for GPs?

An Employment Agreement for GPs is a legally binding contract between a GP (employee) and an employer (usually a medical practice, healthcare facility or hospital). The agreement aims to align expectations between the Practice and the GP, reduce the risk of conflict and protect both parties by commencing the working relationship on the right foot.

It’s been very common for GPs to only be employees when they are registrars but in recent times changes to the law have made some medical practices change their arrangements to employ GPs. We have written an article on the benefits of this arrangement for medical practices and for the General Practitioners themselves, which is available on the news page of our website.

What are the Key Components of an Employment Agreement for GPs?

An Employment Agreement for GPs outlines the terms and conditions of the doctor’s employment, including but not limited to their roles, responsibilities, compensation, benefits, working hours, leave policies, termination, non-compete clauses and governing law.

Can the Terms of an Employment Agreement for GPs be Negotiated?

Yes, the terms of an employment agreement for GPs can be negotiated between the doctor and the employer. Both parties may have specific requirements or preferences that can be discussed and modified, as long as the changes are agreed upon by both parties and do not contravene any law or professional standards (e.g. the Fair Work Act and National Employment Standards).
