Frequently Asked Questions
If you are considering engaging You Legal to prepare a Licence Agreement for use with Pathology, here’s what you need to know:
What’s Included in the Agreement?
In non-legal language, it’s a Room Rental Agreement. In legal language, the document is a Licence which includes definitions of terms, details of the Licensor and Licensee, the relevant terms and conditions of the licence, the licence fee payable, and the permitted use of the Premises, which may or may not, for example, include use of the lunchroom in your practice.
How will this Agreement Benefit me as a Medical Practice sub-letting the room?
This agreement will benefit you if you’re looking to license or rent out a part of your practice to a Pathology provider to assist patients. The Licence Agreement outlines the terms and conditions of the licence and provides a clear understanding of what is expected from both parties during the term of the licence or rental arrangement.
Who is this Agreement Intended for?
This agreement is intended for a practice owner or practice manager who is planning on or has granted a Pathology provider a licence to occupy a part of their premises on certain terms, and wishes to formalise the arrangement for the avoidance of doubt, and in accordance with the requirements of the Red Book.
Is the Agreement easy to use and understand?
Yes, the agreement is designed to be user-friendly and easy to understand.
Can I Customise the Agreement to Suit my Needs?
Yes, our lawyers will discuss your needs and customise the Licence Agreement to suit you, and we will also review your head lease to ensure that it is does not offend any of the provisions in the medical practices lease, whether the real property is owned by the practice or an independent party.
Does this Licence Agreement Include any Services our Practice might offer to a Pathology Company?
This Licence Agreement is purely for a room rental - it does not include services like reception services, access to practice management software or internet, or nursing staff. Usually, this is appropriate for pathology providers who to operate very independently of the medical practice premises they operate from.
What else do I need to be aware of that I may not have thought about?
As mentioned above, some Leases require the landlord’s consent before a Licence or Room Rental Agreement is entered into. You Legal will check your Lease as part of the scope of this engagement and explain the steps you need to take (if any) to engage with another business to obtain consent.
