What Happens if I make a Claim on My MDO Insurance?

You can’t always predict what will go wrong, but what you can know for certain is that being adequately protected against professional risks can take away a layer of stress, in what would be an already stressful time. From assets to reputation, there is undoubtedly a lot at stake, even for the simplest of mistakes. Being underinsured is just simply not worth the risk.

How do I know my MDO is acting in MY best interests?  Aren’t they primarily looking after the insurer?

You might wonder what happens in the event of an insurance claim to your MDO insurer, if lawyers are appointed and they have an obligation to provide advice and support with matters of medical and business nature as covered in our insurance policies, how you can be certain the MDO is acting in the best interests of YOU, rather than their own interests, which include cost and reputation?

There is anecdotal evidence from the medical community that there are often experiences where the MDO has just told doctors to repay the money (say in the event of a Medicare Audit) - even if the doctor has done nothing wrong.  It can seem like you are a number to them, rather than them taking your individual case seriously.  So, how can you know that they are acting in the best interests of you rather than themselves?

Issues arising need to be addressed between an MDO and a practitioner on a case-by-case basis, as so many different circumstances come into play. Each issue needs to be taken up the food chain internally via their complaint’s mechanism.

You Legal often acts as a sounding board for practitioners who have notified their insurance company of a potential claim – sometimes practitioners prefer to know there is someone 100% on their side. If this sounds familiar, you can contact us and our lawyers at You Legal will be happy to assist you in whatever way we can.
